If you become involved in any violation of system security, Synnetix reserves the right to release your details to system administrators at other sites in order to assist them in resolving security incidents. Synnetix reserves the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone posting any email messages or publishing or otherwise making available any materials that are believed to violate these Terms.

You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Services for the reconstruction of any lost data. No advice or information, whether oral or written, obtained by you from the Services or any materials or content available through the Services will create any warranty regarding Synnetix or the Services that is not expressly stated in these terms.

Limitation of liability

SYNNETIX, ITS SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS WILL NOT IN ANY EVENT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES, INCLUDING LOSS OF USE, DATA, REVENUE, OR INCOME, PAIN AND SUFFERING, EMOTIONAL DISTRESS, OR SIMILAR DAMAGES, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SERVICES, WITH THE DELAY OR INABILITY TO USE THE SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF SYNNETIX HAS BEEN INFORMED OF THE POSSIBILITY OF DAMAGES. In all cases, Synnetix will not be liable for any loss or damage that is not reasonably foreseeable or that arises out of any event beyond its reasonable control.
Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

These Terms and any disputes arising under or related to these Terms and/or the Synnetix Privacy Policy will be governed by U.S. federal law and the laws of the State of California. Use of the Services is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including without limitation this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Synnetix as a result of these terms or use of the Services. You further agree that the Terms create no third party beneficiary rights that are not expressly included.
If any part of these terms is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the terms shall continue in effect.
Unless otherwise specified herein, these terms constitutes the entire agreement between the user and Synnetix with respect to the Services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Synnetix with respect to the Services.
A printed version of these terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that these terms and all related documents be drawn up in English.

Changes to the Terms of Use

Synnetix reserves the right to change the terms, conditions, and notices under which the Services are offered. Your continued use of the Services indicates your agreement to the modified terms, conditions, and notices.
